General sales Conditions

We provide our deliveries and work and services exclusively in accordance with these General Sales Conditions. Contradictory or conflicting conditions of the customer shall not be acknowledged unless we expressly consent to their validity.

1. PRICE

The prices are shown in Euros VAT and other taxes included, excluding shipment costs. The transport and the price of the order depends on the weight and the distance to the country of the receiver. Shipping costs will be applied to the order at checking out.

In case of orders to a country other than Metropolitan France the client is considered as IMPORTER of the product or products concerned. For all products send out European Union and DOM-TOM, the price on the invoice will be automatically calculated without taxes. In the case of deliveries of goods to countries outside France, it is possible that import dues will be charges when importing goods. The customer is responsible for paying these. The amount of the import dues varies in different customs areas. The customer shall be responsible for paying all the necessary customs dues and fees in a proper manner.

MonCoinSanté will be free to modify the prices at any time and without any obligation to provide notice, but the price of the Goods shall be the price set out in the web site at the moment of checking-out. 
Products will remain the property of the Seller until total payment of the Price by the Client and, in the case of payment by bills or cheques, until their successful conclusion.

Payment of the price of the goods is due in Euros (EUR).


2. ORDER

All orders will be placed directly in the site MonCoinSanté.

Contract informations are in French, English and Spanish. Before confirming your order and accessing the payment’s phase, you must preliminary have accepted without reserve the entirety of the General terms of Sale. If the Client delays a payment totally or partially, the Seller may suspend any pending delivery.Actually, MonCoinSanté  , in its sole discretion, reserves the right to refuse service to anyone, with no need to justify cause or reason, in case of problem occurred with the database. MonCoinSante reserves the right to refuse sales at our discretion if we believe there is a fraudulent credit card use.

3. CONFIRMATION

By placing an order with MonCoinSanté, the client agrees to adhere to these conditions without reservation.  The confirmation of your order means that you accept these conditions.

The automatic-recording systems are regarded as being worth proof of the nature and the contents of the order. The recorded site’s data constitute the proof of the whole transaction passed between You and MonCoinSanté.

4. AVAILABILITY

Products offered are those which appear in the catalogue published on this Web site. These products are offered within the limit of stocks available, with the exception of promotions so called on the site. . If an item is out of stock we will inform you by e-mail. Your order will be automatically cancelled and no payment will be done. 

5. DELIVERY

Delivery is made to the address given when you order. Delivery times are approximate and represent average delivery times corresponding to the time normally required to process and deliver an order. Mon Coin Santé may not be held responsible for any consequences of a delay in delivery, particularly in the event of a force majeure, computer breakdowns, and disruption or strikes affecting postal services, transport or communications.

When the customer takes order of one or more articles of which the availability is not immediate, the order will be sent when whole of the products will be available. Mon Coin Santé reserves the right to supply part of your order and back order the remainder and send it as soon as it is available. There is no price difference for splitting the order in this way.

In the event that at the moment of delivery, the recipient is not available or whether an error in the address makes impossible the delivery of the products, the Client should agree with the transport service a new date for delivery. All extra charges should be paid by the Client.

You can always check the status of your order (available in the page “My account”) and contact our Customer service for any question or in case of problem.

Mon Coin Santé cannot accept any responsibility for orders which are delayed or lost due to the transport service, including loss or strike.  

The client must examine the goods upon receipt. The client is required to confirm that they are the intended recipient of the products delivered (verification of package labels), that there are no missing packages, and that the packages received are in good condition before the carrier leaves the premises. If a package is missing or if a package shows evidence of mishandling, the client is required to note these reservations on the bill of lading submitted by the carrier and to confirm it by recorded in the following 48h. According to the law of transportation, the bill of landing is the only proof in case of dispute. A signature means that the packages received are in good condition.

If reservations were noted with the carrier when the goods were received and if, upon re-inspection, there is truly a package missing or items damaged, these reservations must be confirmed by registered letter with confirmation of receipt date sent to both the carrier and to Mon Coin Santé within two days from the delivery.

 

6. PAYMENT

You can pay your orders by:

Online payments by credit card use the secure system e-transactions of Crédit Agricole French Bank.

7. SECURITY

MonCoinSanté SSL relies on the Secure Sockets Layer (SSL) protocol to create a uniquely encrypted channel for private communications over the public Internet in order to protect all personal data during payment.

8. SATISFIED OR REFUNDED

- RIGHT OF REVOCATION

If, within fourteen calendar days, you no longer require all or part of your order, providing that the product remains unopened and in its original packaging, the item may be returned at the customer's cost for a full refund excluding postage.

The return will be accepted only if the product was not opened and not used. Products sold under blister pack or provided with a label of guarantee must have returned as is. Medicines, drugs, homeopathic and hygiene products can not be refunded.

9. REFUND

You can cancel your order after dispatch, according with article 8 and within 14 days of the date on the receipt that accompanies your order as long as they are unused and in their original packaging and condition. A refund will only be credited back to the credit card holder’s account which was used to make the original purchase. You will be asked to confirm these details again in order to process a refund. In case of revocation by the client MonCoinSanté will wait for the return of the products before processing the refund. 

Any avantages obtained when buying the produc t will be cancelled in the event of return and refund of the product.

11. INTELLECTUAL PROPERTY RIGHTS

1. All the content of the Site, texts, photos, drawings (animated or not) and any other components of this site are property of Mon Coin Santé.

2. It’s not allowed to copy and/or to reproduce in whole or in a part the content of the Site without the express authorization of Mon Coin Santé. The contents of this page are protected by the applicable French Intellectual Property Code, clause L.335-2 and following.

3. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these General Conditions, is strictly prohibited and protected by the French Intellectual Property Code, clause L.713-2.

All our products are in accordance with the French applicable law. Client is responsible for compliance with all laws and regulations applicable in the country of destination regarding import, delivery, storage and use of theProducts delivered by Mon Coin Santé. Client shall inform Mon Coin Santé if such laws or regulations require any actions on it's part.

No matter the case Mon Coin Santé can’t be held responsible for losses of benefit, commercial losses, data losses or shortfall or any other indirect damage which are not predictable at the time of the use of the Site or the results of the orders with a professional purpose.

13 - APPLICABLE LAW AND JURISDICTION



These Terms and Conditions of Use will be governed and interpreted in accordance with the laws Valenciennes, France.
This contract is governed by French law.
You and Mon Coin Santé agree to submit to the non-exclusive jurisdiction of the courts  of VALENCIENNES- FRANCE.

ARTICLE 16 - ORDER OF  LABORATOIRES PIERRE FABRE PRODUCTS 



For orders of  LABORATOIRES PIERRE FABRE products, client can order maximum 6 articles of the same reference. For orders of more that  6 units, MonCoinSanté will ask LABORATOIRES PIERRE FABRE if it is possible. Shipping  LABORATOIRES PIERRE FABRE products outside EEE is not permited. 

ARTICLE 17 – SPECIFIC RULES CONCERNING ON LINE SALE OF DRUGS

17.1. The right of revocation is not applicable

The revocation right is not applicable because drugs are health products, and they may deteriorate. The absence of right of revocation is also justified by the security requirements of the supply chain. Actually, a product taken out of the distribution and dispensing network cannot return to this network.

The absence of right of revocation must be indicated clearly and readable before order confirmation and must be expressly mentioned in the conditions of use and sale.

17.2. Claims

In case of dispensing error (when the patient receives a different product or a damaged product), the pharmacist mentioned in 1st and 2nd of the article L.5125-33 of the Public Health Code provides the reimbursement methods and the forwarding of this product by the patient. These methods are clearly stated in the General Sale Conditions.

The product forwarded by the client is treated according to law in force concerning unused human use drugs (art. R. 4211-23 à R. 4211-31 of the Public Health Code). The pharmacist mentioned in 1st and 2nd of the article L.5125-33 of the Public Health Code provides traceability and archiving of this operations.
